Nassau Bahamas – The Free National Movement’s MP for Pinewood, Byron Woodside has failed in a bid to have the election court justices throw out particulars in the Pinewood constituency.
Senior Justice Anita Allen and Justice Jon Isaacs released their written ruling before a packed court on Friday morning. The legal team of Pinewood MP Byran Woodside had asked the court to strike out Mrs. Maynard Gibson’s petition in its entirety.
The justices refused to strike out the list of names Mrs. Maynard Gibson filed in accordance with rule 14 of the Election Court rules, which says any person who claims a seat on the grounds that he or she had a majority of the lawful votes must file at least seven days before the start of the trial a list of all the votes that were allegedly unlawful.
In the petition, Mrs. Maynard Gibson says that at least 266 people were not entitled to vote in Pinewood on May 2, 2007 because they were not nor had they been at some time during the period of six months immediately preceding that date ordinarily resident in Pinewood and their purported votes were counted and contributed to Mr. Woodside’s victory.
Mrs. Maynard Gibson claims in her petition that she is entitled to a declaration that Mr. Woodside’s election was undue, a scrutiny and a declaration that she was duly elected and ought to have been returned.
Mr. Woodside received 1,945 votes in the race for Pinewood on May 2, and Mrs. Maynard Gibson received 1,881 votes.
Mrs. Maynard Gibson released a brief statement after the Election Court ruling was delivered.
The statement said, “We are very pleased that the Election Court refused the Hon. Byran Woodside’s application to dismiss our petition. Senator the Hon. Allyson Maynard Gibson’s petition claiming that she received the majority of the lawful votes in the Pinewood election stands. The trial begins on Monday, October 22, 2007.”
I think her problem is she hates to lose. She fails to understand the people have spoken and they have clearly made their choice she needs to go and move on
